General Terms:
* Ace Precision Firearms Inc Reserves the right to update and or change product or terms at any time without prior notice.
* All Firearms requires a 100% Payment Up Front and if canceled only 20% of the payment received will be refunded.
* Order is effective once Payment is received and payment has cleared.
* Delivery times are estimated at the time of order. We will do our best to hit or beat those estimates but, under NO Circumstances will we rush our orders just to get it out to you. We will not compromise the quality of our firearms. A delay in delivery is not grounds for a refund of the non refundable deposit.
* At Ace Precision Firearms Inc we want your 100% satisfaction. If there is an issue with your firearm you may contact us anytime during our normal business hours. We may elect to repair the firearm without charge at our sole and absolute discretion. If we determine that the firearm was customer abused, worked on by a party not employed by Ace Precision Firearms Inc, or modifications have been made outside of our company, we will do not work on the firearm. Feel free to call us during our office hours for questions regarding this. This is not to be construed as a warranty, either full or limited.
* All firearms include Federal Excise Tax.
* Final Payment Must be made and cleared Before Any Firearms are Shipped.
* We do except Cashiers, Certified, or Personal Checks along with Credit Card. There is a 4% convenience fee to use a Credit Card. There may be a delay if paying by personal check for the check to clear our financial institution.
* Wire Transfers are accepted as well Domestic. ??
* All International orders shall be paid by Wire Transfer or Certified Check. No other methods are accepted.
* The following is required for all International orders:
* Purchase Order
* Original Import Certificate/Permit translated into English and provided in its original format
* Proof of Gun Dealer status in your country, if for resale
* Letter explaining these products will be available for commercial sale within your country of business, if for resale
* Letter explaining the product will be for personal use only and not for resale if for individual buyer
* Buyer shall be responsible for all duties, import taxes, and import charges.
* Buyer is responsible for the costs of any export license.
* All International shipping is Only From our Door to your local International Airport.
* Shipping/Handling/Out of Country License costs are not included in our pricing.
* Product may not be sold, leased or transferred to restricted countries, restricted end users, or for restricted end uses.
* Absolutely NO EXCEPTIONS to above terms!
Note: All Firearms must be ordered through a Licensed FFL holder.
The Magnuson-Moss Act (Public Law 93-637) does not require any seller or manufacture to give a written warranty. It does provide that if a written warranty is given, it must be designated as “limited” or as “full” as sets minimum standards for a “full” warranty. Ace Precision Firearms Inc has elected to not provide any written warranty, either “limited” or “full”, rather than attempt to comply with the Provisions of the Magnuson-Moss Act and the Regulations issued thereunder. There are certain implied warranties under state law with respect to sales of consumer goods. As the extent and interpretation of these implied warranties varies from state to state, you should refer to your state statutes. Ace Precision Firearms Inc wishes to assure its customers of its continued interest in providing service to owners of Ace Precision Firearms Inc firearms.
The U.S. Government views the sale, export, and re-transfer of defense articles and defense services as an integral part of safeguarding U.S. national security and furthering U.S. foreign policy objectives. The Directorate of Defense Trade Controls (DDTC), in accordance with 22 U.S.C. 2778-2780 of the Arms Export Control Act (AECA) and the International Traffic in Arms Regulations (ITAR) (22 CFR Parts 120-130), is charged with controlling the export and temporary import of defense articles and defense services covered by the United States Munitions List (USML).
SELLER DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN. EXCEPT AS EXPRESSLY PROVIDED HEREIN, SELLER WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR FOR ANY CLAIM BY ANY THIRD PARTY. YOU AGREE THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCT, SELLER IS NOT LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AMOUNT INVOICED FOR THE APPLICABLE PRODUCT. SOME JURISDICTIONS MAY NOT ENFORCE ALL OF THESE LIMITATIONS, AND ONLY THE LIMITATIONS THAT ARE LAWFULLY APPLIED TO YOU IN YOUR JURISDICTION WILL APPLY.
Any terms of your relationship or dealings with Ace Precision Firearms Inc. (“ACE”) will be governed and construed in accordance with the law of the State of Illinois, without regard to Illinois’ conflict of law rules. Any litigation between ACE and YOU or YOUR heirs, representatives, successors, or assigns shall be filed before a court of competent jurisdiction and venue in the 14th Judicial District, Rock Island County, of the State of Illinois. YOU HEREBY CONSENT TO THE IN PERSONAM JURISDICTION AND VENUE OF THE ILLINOIS COURTS, AND THAT SERVICE OF THE PROCESS MAY BE MADE UPON YOU AS PROVIDED BY ILLINOIS LAW.
